Saleshandy is dedicated to meet all the GDPR requirements and is committed towards protecting the privacy concerns of our app users, website and blog visitors, as well as email lists subscribers.

When you visit saleshandy.com, we use Cookies to log the visitors’ behavior on our website. This allows us to collect statistical data necessary to asses and improve the usability and effectiveness of the site. Using Cookies, the way we do, does not allow us to personally identify any of the website visitors, but only to analyze numerical, geographic, and demographic data for statistic purposes and analysis of behavioral patterns.

  • Increased clarity on what information is collected and why

This Data Processing Addendum ("DPA") forms part of the Saleshandy Terms of Service and Privacy Policy, and governs the processing of Personal Data by Saleshandy. By using Saleshandy’s services, you agree to this DPA in addition to the Terms of Service and Privacy Policy.

  1. In this DPA, the following terms have the following meanings:

    • "Affiliate": An entity that directly or indirectly Controls, is controlled by, or is under common Control with an entity.
    • "Authorised Affiliate": Any Affiliate(s) of the User permitted to use the Service.
    • "Controller": The entity that determines the purposes and means of the processing of Personal Data.
    • "Processor": The entity that processes Personal Data on behalf of the Controller.
    • "Personal Data": Any information relating to an identified or identifiable natural person.
    • "Sub-processor": Any third party appointed by Saleshandy to assist in processing Personal Data on behalf of the Subscriber.
    • "Data Protection Laws": Includes all data protection and privacy laws, such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
    • Purpose: Saleshandy will process Personal Data to provide services such as email outreach, tracking, lead generation, email validation, and other related services.
    • Personal Data Processed: This may include names, email addresses, phone numbers, IP addresses, and email engagement data.
    • Sub-processors: Saleshandy may engage Sub-processors to assist in data processing, which can be reviewed in the Sub-processor List on our website.
    • Data Controller: The Subscriber is the Data Controller and determines the purposes for processing Personal Data.
    • Data Processor: Saleshandy is the Data Processor and will process Personal Data on behalf of the Subscriber, as outlined in the Terms of Service.
    • Authorisation: The Subscriber agrees that Saleshandy may engage Sub-processors to assist in processing Personal Data. A list of Sub-processors currently engaged can be found at the Sub-processor List.
    • Objection to Sub-processors: If Saleshandy intends to add new Sub-processors, it will notify the Subscriber. The Subscriber may object to new Sub-processors by submitting a request through their support channel within a reasonable time. If no objection is raised, the new Sub-processor will be deemed acceptable.
  2. Saleshandy will implement appropriate security measures, such as:

    • Encryption: Ensuring encryption of Personal Data both in transit (e.g., using TLS) and at rest (e.g., using AES-256).
    • Access Controls: Restricting access to Personal Data based on roles and permissions.
    • Security Audits: Regular security audits and vulnerability assessments.
    • Incident Response: A clear plan to respond to any data breaches or security incidents.
    • Retention: Saleshandy will retain Personal Data only as long as necessary to provide the services. Personal Data may be retained longer if required by law or for legal obligations (e.g., tax, accounting). Upon termination of the Agreement, Saleshandy will delete or anonymise Personal Data upon request, unless retention is required by law.
    • Requests: Saleshandy will assist the Subscriber in responding to requests from Data Subjects to access, correct, delete, or port their Personal Data. For such requests, the Subscriber should contact Saleshandy at dpa@saleshandy.com
    • Notification: Any requests from Data Subjects will be promptly communicated to the Subscriber. Saleshandy will respond to such requests within 30 days, in line with applicable laws.
    • Indemnification: Saleshandy agrees to indemnify and hold the Subscriber harmless from any claims, damages, or losses arising from Saleshandy’s failure to comply with the DPA or applicable data protection laws.
    • Liability Cap: Saleshandy’s liability is subject to the caps and limitations specified in the Terms of Service.
  3. This DPA shall be governed by and construed in accordance with the laws of India. The courts located in Ahmedabad, Gujarat, India, shall have exclusive jurisdiction over any disputes arising out of or in connection with this Agreement.

  4. Any amendments to this DPA must be in writing and signed by both Parties. Saleshandy may update the Privacy Policy and Terms of Service at its discretion, with changes becoming effective once posted on the website. Subscribers will be notified of significant changes.

  5. By using Saleshandy’s services, you acknowledge and agree to the terms outlined in this Data Processing Addendum as part of the Terms of Service and Privacy Policy.

Saleshandy has authorised the subprocessors on this list to process personal data so we can provide Saleshandy’s product and services. Prior to engaging with any subprocessor, Saleshandy performs due diligence to evaluate their privacy and security practices, and requires each to commit to written obligations regarding their security controls and obligations.
